Chapter 6 Crimes Against Morality and Drug Abuse Figure 6-1 The subsequent marriage is void unless the former marriage is terminated by annulment, divorce, or death of the former spouse. 1. Fornication is sexual intercourse between two unmarried persons. Adultery is sexual intercourse by a married person with someone other than his or her spouse or by an unmarried person with a married person. 2. A marriage contracted while either party thereto has a spouse still living is void and of no legal effect. 3. In some states if one of the parties entered the marriage in good faith without knowledge of the impediment, the second marriage will become valid by death or divorce of the former spouse if the parties continue to live together in good faith on the part of one of them. 4. Relationships by consanguinity that one cannot legally marry are one's mother or father, grandmother or grandfather, daughter or son, aunt or uncle, sister or brother, and niece or nephew. 5. Consanguinity means being related by blood; affinity means being related by marriage. 7. Miscegenation statutes are against the law in violation of the equal protection clause and the due process clause of the Fourteenth Amendment of the U.S. Constitution. 8. Under Roe v. Wade, during the first three months of pregnancy, a woman can have an abortion without interference by the state. States are allowed to pass laws to protect the mother's health during the second three-months of pregnancy by making rules as to who can perform abortions and where they can be performed. State laws may prohibit abortions during the last three months of pregnancy, with exceptions to protect the life or health of the mother. 9. The three-part test to determine obscenity is: (a) An average person, applying modern community standards, would find that the work taken as a whole appeals to prurient interests, (b) the matter must show or describe sexual conduct in a way that is openly offensive, and (c) the work, taken as a whole, has no serious literary, artistic, political, or scientific value. 10.
