The Court decided that intrusions on the constitutionally protected privacy interests of government employees for non-investigatory, work-related purposes, as well as for investigations of work-related misconduct, should be judged by the standard of reasonableness under all the circumstances. Under this standard, both the inception and the scope of the intrusion by the employer must be reasonable. The Court determined that it could not determine whether the search of Dr. Ortega's office and the seizure of his belongings satisfied the standard of reasonableness because the parties were in dispute about the actual justification for the search, and the record was inadequate for a determination of the reasonableness of the search and seizure. The case was thus remanded to the district court.
