Post by: umass508 on Jan 27, 2018 The ADEA allows an employer to observe the terms of a bona fide seniority system or employee benefit plan, such as a retirement or pension plan, as long as the plan or system is not subterfuge to evade the purpose of this Act. The ADEA provides, however, that no seniority system or benefit plan shall require or permit the involuntary retirement of any individual.
