Studies have indicated that race plays a decisive role in the question of who lives and dies by execution in the United States. According to some studies, race can influence which cases are chosen for capital prosecution and which prosecutors are allowed to make those decisions. A January 2003 study released by the University of Maryland concluded that prosecutors are more likely to seek a death sentence when the race of the victim is white and are less likely to seek a death sentence when the victim is African-American.
