Plea bargaining plays a major role in the federal judicial system. Approximately 90% of all federal sentences are the result of guilty pleas, 28 and the large majority of those stem from plea negotiations. Although the commission allowed plea bargaining to continue, it required that the agreement (1) be fully disclosed in the record of the court (unless there is an overriding and demonstrable reason why it should not be) and (2) detail the actual conduct of the offense. Under these requirements, defendants are unable to hide the actual nature of their offense behind a substitute plea.
