In Reno v. ACLU, the U.S. Supreme Court ruled that provisions of the Communications Decency Act violated First Amendment guarantees of free speech. While the Act may have been legally unconstitutional, should the Court have considered the ethical issues underlying the Act? The Act may be unconstitutional but is it immoral? Should ethics become a part of the decision when child victims are involved?
