Statistics show that the death penalty is applied most often to men, disproportionately to minorities, and invariably to poor defendants. However, murderers are also women, whites, and people from middle- and high-income brackets. It is unfortunate that those extra-legal factors influence the death penalty but since they do, the death penalty must be considered to be unfair. Retributionists point out that this still doesn't mean the death penalty is unfair, only that it is being administered unfairly. Those people who are successfully avoiding execution because of their gender, race, or income still deserve the death penalty and the "fix" should be directed toward accomplishing that goal rather than abolishing the death penalty.
