T - Must contain an element of force, fraud, or coercion (actual, perceived, or implied), unless victim under 18 years of age is involved in commercial sex acts.
S - The person being smuggled is generally cooperating.

T - Forced labor and/or exploitation.
S - No forced labor or other exploitation.

T - Persons trafficked are victims.
S - Persons smuggled are violating the law. They are not victims.

T - Victims are enslaved, are subjected to limited movement or isolation, or have had documents
confiscated.
S - Smuggled individuals are free to leave, change jobs, etc.

T - Need not involve the actual movement of the victim.
S - Facilitates the illegal entry of people from one country into another.

T - May or may not cross an international border.
S - Always crosses an international border.

T - Victim must be involved in labor/services or commercial sex acts (that is, must be “working”).
S - Person must only be in country or attempting entry illegally.
