(Answer to #1)  The employee has violated the Electronic Communications Privacy Act (as well as the Federal Communications Act which is not discussed in Chapter 11). The satellite company could bring a private right of action against the employee under the Electronic Communications Privacy Act. This hypothetical is similar to the facts in DIRECTV Inc. v. Seijas, 508 F.3d 123 (3rd Cir. 2007).
