To be an effective deterrent, punishment must be certain, severe, and swift. Each is difficult to implement since citizens are likely to recoil at being constantly monitored (making certainty difficult to achieve), have different ideas about whether a particular punishment is severe or mild (making it difficult to standardize severity), and are unlikely to compromise their due process rights (making swift application of punishment difficult).
