Company Rule G prohibits the use of alcohol or drugs not only while on duty but also while subject to duty.. Give your opinion as to whether an employer can properly regulate the actions of its employees when they are off duty and not being paid.

The public and fellow employees have a right to have trains operated in a safe manner by employees who are properly qualified to operate the trains. The Hours of Service Law restricts train operating personnel to no more than twelve hours of work without a minimum eight hours of rest in the interest of public safety. Also, in the interest of public safety, an employer may require that its employees not consume alcoholic beverages during the appropriate period of time prior to their reporting to work. The employees' freedoms during off-work hours have a limited restriction that they not consume alcohol while subject to duty because of public safety considerations.
