Capital punishment is constitutional if state statutes clearly provide that, during the sentencing process, the following condition(s) is(are) met:
 
  a. the court is informed about the defendant's background.
  b. mitigating factors affecting culpability are brought to the attention of the court.
  c. every death sentence is reviewed by a state appellate court.
  d. all of these choices.
