(Answer to Q. 2)  An encroachment occurs when a property owner builds or erects something on the land of an adjoining property owner, usually along the boundary line of the adjoining properties. An encroachment can be intentionally but is more likely inadvertent, such as a the erection of a fence on what one believed to be the boundary line.

(Answer to Q. 3)  Local governments seek to control development of the land within their boundaries through zoning codes. Building codes are adopted in order to have buildings erected with certain safety concerns addressed. Both of these limit the free use of the property.
