 IDEA provisions related to discipline:
Parents must be given an opportunity to participate in all meetings for identification, evaluation, and educational placement (applies to behavior problems too).
Unique circumstances can be considered on a case-by-case basis regarding change in placement.
Student's progress toward accomplishment of IEP goals and objectives must continue during change of placement (access to general curriculum and BIP must continue).
A special meeting must be held within 10 days of a decision to change a student's placement because of a behavior code infraction (manifestation determination).
Student may be given an appropriate interim alternative education setting or suspension of not more than 10 days in the same year.
Parents are notified of all procedural rights under IDEA including expanded disciplinary rights not later than the day the decision to take disciplinary action is made.
Students may be moved to an interim alternative education setting for up to 45 school days for weapons at school, possession or use of illegal drugs, selling or soliciting sale of a controlled substance.
FBA must look across contexts to include school, home, community when behavior impedes the student's learning or learning of others.
