An innkeeper is the owner of a facility that provides lodging to the public for compensation. Under the common law, innkeepers owe a duty of strict liability regarding loss caused to the personal property of transient guests. Under this rule, an innkeeper is liable for a guest's personal property that is lost or stolen from the innkeeper's premises even if the loss was not the innkeeper's fault. Permanent lodgers are not subject to this rule. However, almost all states have enacted innkeepers' statutes that change the common law and limit the liability of innkeepers. These statutes allow innkeepers to avoid liability for loss caused to guests' property if a safe is provided in which the guests' valuable property may be kept and the guests are aware of the safe's availability. Most state laws also allow innkeepers to limit the dollar amount of their liability by notifying their guests of this limit.
