Liability of the Bailee. Several individuals placed personal property in a storage facility offered by the Winnebago County Fair Association, Inc All who stored property in the building were required by the Winnebago County Fair Association to sign a storage agreement that in-cluded the following provision: No liability exists for damage or loss to the stored equipment from the perils of fire. The storage building burned down, and all the property within was de-stroyed. A number of the people who had stored their property in the building brought suit against the fair association, claiming that the fire resulted from its negligence. Allstate Insurance Co, which had paid a number of claims for losses incurred due to the fire, joined the plaintiffs in the lawsuit. The Winnebago County Fair Association claimed that the exculpatory clause in its contract relieved it from any and all liability. The issue before the court was whether the bailee (the fair association) could validly contract away all liability for fire damage. What was the result?
