A riot is a group of three or more people involved in a public disturbance of the peace. Various dimensions of rioting are criminalized at both the federal and state levels. At the federal level, one who incites, encourages, participates in, and/or carries out a riot may be guilty of an offense—provided there is an interstate or foreign commerce dimension to the activities. Riot closely parallels unlawful assembly, as each occurs when a group consisting of a certain number of people assembles unlawfully—or for an unlawful purpose. Both are distinct, however. The classic example of unlawful assembly is a protest. When a protest turns violent, then riot often occurs. A riot is the culmination of both unlawful assembly and rout.
