This could be the rarest case maybe where two contestants from two different political parties gaining the maximum number of votes are in a tie.

i.e. Same number of votes.

In this case, will a re-election takes place according to constitution rules?

Before a draw it considered, most parties will request a recount. What happens afterwards depends on the country, I suppose.
