Discovery is the pretrial phase of a lawsuit in which each party can obtain evidence from the other party by various means, including requests for the production of documents. The purpose of discovery is to ensure that all parties will go to trial with as much knowledge as possible. Under the rules of discovery, neither party is able to keep secrets from the other. Should a discovery request be objected to, the requesting party may file a motion to compel discovery with the court.
Electronic discovery (e-discovery) is the collection, preparation, review, and production of electronically stored information for use in criminal and civil actions and proceedings.
