Hazardous Waste. The Resource Conservation and Recovery Act gives the Environ-mental Protection Agency (EPA) authority to require a company to clean up a hazardous waste site that presents an imminent and substantial endangerment to public health or to the envi-ronment. A company disposed of dioxin by discharging it into a pond located on its property. The EPA ordered that the company stop the disposal and clean up the site. The company ar-gued that the EPA had no evidence of any actual harm to the health of nearby residents. Should the company be compelled to clean up the dioxin even in the absence of evidence of actual harm? Discuss.
