Firms provide training and guidance to employees who may encounter situations in which antitrust concerns are present. A firm may find itself in a situation in which a contemplated practice falls in an area in which the antitrust laws and the court decisions interpreting them are unclear or changing. In addition to seeking the advice of counsel, the firm should examine whether the purpose of its practice is anticompetitive. In court situations, a firm should attempt to use practices that are the least restrictive in achieving the desired purpose.
